Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "Customer," or "Plumber") and FixaFlow ("we," "us," or "our"), governing your access to and use of ifixaflow.com and all associated services.

By accessing or using FixaFlow, creating an account, or booking a service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately cease use of our platform.

Description of Service

FixaFlow is a technology platform that connects customers seeking plumbing services with independent, licensed plumbing professionals. FixaFlow does not itself provide plumbing services and is not a plumbing company.

• We facilitate the booking, communication, and payment process between customers and plumbers
• We do not employ plumbers — all service providers are independent contractors
• We do not guarantee availability, response times, or specific outcomes of any service
• We reserve the right to refuse service, suspend, or terminate any account at our sole discretion

Independent Contractor Relationship

All plumbers operating on the FixaFlow platform are independent contractors and not employees, agents, partners, or representatives of FixaFlow. FixaFlow does not control the manner in which plumbers perform their work and is not responsible for the quality, timeliness, legality, or safety of any services performed.

Any disputes regarding the quality of work, damages, or personal injury must be directed to the plumber directly. FixaFlow assumes no liability for the actions or omissions of any service provider on the platform.

Customer Responsibilities

As a customer using FixaFlow, you agree to:

• Provide accurate information when submitting a booking, including your address, phone number, and description of the issue
• Be present or make the property accessible at the agreed service time
• Pay for all services rendered at the agreed rate before or upon completion
• Treat service providers with respect and not engage in abusive, threatening, or discriminatory behavior
• Not attempt to solicit plumbers outside of the FixaFlow platform to circumvent our fee structure
• Comply with all applicable local laws regarding property access and plumbing work

Plumber Responsibilities

As a plumber registered on FixaFlow, you agree to:

• Maintain all required licenses, certifications, and insurance required by your jurisdiction
• Accept only jobs you are qualified and available to complete
• Provide accurate quotes and not engage in price gouging or deceptive billing practices
• Complete accepted jobs in a professional and timely manner
• Not solicit customers outside the platform to avoid FixaFlow fees
• Comply with all applicable laws, building codes, and safety regulations
• Accurately represent your qualifications, experience, and availability on your profile

Payments & Fees

All payments on the FixaFlow platform are processed securely through Stripe. By using our platform, you agree to Stripe's Terms of Service in addition to these Terms.

• Customers are charged the amount quoted and approved prior to service completion
• Plumber payouts are processed automatically following job completion and customer approval
• FixaFlow charges a platform fee on each transaction, deducted from the plumber's payout
• Refunds are handled on a case-by-case basis at FixaFlow's sole discretion
• Chargebacks initiated without first contacting FixaFlow support may result in account suspension

SMS Communications

Prohibited Conduct

The following actions are strictly prohibited and may result in immediate account termination and legal action:

• Providing false or misleading information on your account or booking
• Harassing, threatening, or discriminating against other users or service providers
• Circumventing the platform to conduct transactions outside of FixaFlow
• Attempting to hack, scrape, or interfere with the platform's systems
• Using the platform for any illegal purpose
• Creating multiple accounts to abuse promotions or circumvent bans
• Posting false reviews or engaging in any form of platform manipulation

Limitation of Liability

To the maximum extent permitted by applicable law, FixaFlow and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Property damage resulting from plumbing services performed through the platform
• Personal injury sustained during a service appointment
• Loss of data, revenue, or profits
• Service delays, cancellations, or no-shows by independent contractors
• Unauthorized access to your account resulting from your failure to secure your login credentials

FixaFlow's total liability to you for any claim arising out of or relating to these Terms or your use of the platform shall not exceed the total amount paid by you to FixaFlow in the 90 days preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless FixaFlow and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the platform, your violation of these Terms, or your violation of any third-party rights.

Termination

FixaFlow reserves the right to suspend or permanently terminate any account at any time, with or without notice, for any reason including but not limited to violation of these Terms, fraudulent activity, or conduct deemed harmful to the platform or its users. Upon termination, your right to use the platform immediately ceases.

Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, and you waive any right to a jury trial or class action lawsuit against FixaFlow.
